Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Salesnado platform, including all related services, features, and applications (collectively, the "Service"), provided by KJ Bucketlist Investments, LLC ("Company," "we," "us," or "our"), a Texas limited liability company based in Austin, Texas. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

Salesnado is an AI-powered sales development platform that deploys autonomous AI agents to conduct cold email outreach on your behalf. The Service includes AI agent provisioning, email sequence generation, contact management, reply handling, lead sourcing, knowledge base ingestion, and related features. AI agents operate autonomously within the parameters you configure, including email content, target audience, sending frequency, and reply behavior. You acknowledge that AI agents will send emails, respond to replies, and take actions without requiring your approval for each individual action, subject to the safety guardrails described in our documentation.

2. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 18 years of age and have the legal authority to enter into these Terms on behalf of yourself or the entity you represent. You agree to notify us immediately of any unauthorized use of your account.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with all applicable laws, including but not limited to the CAN-SPAM Act, GDPR, CCPA, and any other applicable anti-spam and data protection regulations. You are solely responsible for the content your AI agents send, the contacts you upload, and the configurations you set. You may not use the Service to:

• → Send unsolicited commercial email in violation of applicable anti-spam laws.
• → Transmit content that is defamatory, obscene, fraudulent, deceptive, or otherwise objectionable.
• → Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• → Upload contact lists obtained through unlawful means or without proper consent.
• → Attempt to circumvent rate limits, safety guardrails, or other platform restrictions.
• → Use the Service for any activity that could harm the reputation or deliverability of our shared infrastructure.

4. Email Sending and Anti-Spam Compliance

All email sending through the Service is subject to strict anti-spam compliance. You represent and warrant that all contacts you upload or source through the platform have a lawful basis for receiving commercial email. You agree that all emails sent through your agent will include a valid physical mailing address and an unsubscribe mechanism as required by applicable law. We reserve the right to suspend or terminate your account immediately if we detect spam-like sending patterns, excessive bounce rates, or complaint rates that exceed industry thresholds. Our AI agents include 7-layer safety guardrails to prevent abuse, but you remain ultimately responsible for your use of the Service.

5. Payment Terms

The Service is offered on a subscription basis. Payment is processed through Stripe, Inc. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring monthly basis at the applicable subscription rate. All fees are quoted in U.S. dollars and are exclusive of applicable taxes. You are responsible for providing accurate billing information and keeping your payment method current. If a payment fails, we may suspend your account and pause your AI agents until payment is resolved.

Subscription tiers and pricing are as follows at the time of publication: Starter ($149/month, 500 leads, 2,000 emails), Growth ($399/month, 2,000 leads, 8,000 emails), and Scale ($799/month, 5,000 leads, 20,000 emails). We reserve the right to modify pricing with 30 days' written notice to active subscribers.

6. Refunds and Cancellation

You may cancel your subscription at any time through the Service or by contacting us at keith@salesnado.com. Cancellation takes effect at the end of the current billing period. No prorated refunds are provided for partial months. Upon cancellation, your AI agents will be deactivated and no further emails will be sent on your behalf. Your data will be retained for 30 days following cancellation, after which it may be permanently deleted.

7. Intellectual Property

The Service, including all software, algorithms, designs, and documentation, is the intellectual property of KJ Bucketlist Investments, LLC and is protected by applicable intellectual property laws. You retain ownership of all content you upload to the Service, including contact lists, knowledge base documents, and email templates. By uploading content, you grant us a limited, non-exclusive license to use, process, and store that content solely for the purpose of providing the Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KJ BUCKETLIST INVESTMENTS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You acknowledge that AI agents operate autonomously and that we cannot guarantee the accuracy, appropriateness, or effectiveness of any individual email or response generated by the Service. We are not liable for any damages arising from emails sent by your AI agents, including reputational harm, lost business, or legal claims brought by email recipients.

9. Indemnification

You agree to indemnify, defend, and hold harmless KJ Bucketlist Investments, LLC, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) the content of any emails sent through your account; or (e) any third-party claim arising from your use of the Service.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for immediate termination include, but are not limited to: violation of these Terms, excessive spam complaints, fraudulent activity, non-payment, or any use that threatens the integrity of our platform or shared infrastructure. Upon termination, all rights granted to you under these Terms will immediately cease. Sections 7, 8, 9, 11, and 12 shall survive termination.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Travis County, Texas. You consent to the personal jurisdiction of such courts and waive any objection to venue. Any claim arising under these Terms must be brought within one (1) year after the cause of action accrues, or such claim shall be permanently barred.

12. General Provisions

These Terms constitute the entire agreement between you and KJ Bucketlist Investments, LLC regarding the Service and supersede all prior agreements and understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. We may assign these Terms without restriction. You may not assign your rights or obligations under these Terms without our prior written consent. We may modify these Terms at any time by posting the revised version on our website. Your continued use of the Service following any changes constitutes acceptance of the modified Terms.
